Indemnity

Guest at 58 (Pty) Ltd, trading as Guest@58 (“Guest@58”), 58 Rensburg Street, Lydenburg (Mashishing), Mpumalanga (“the Premises”).

This indemnity applies to all persons who enter the Premises, whether as a casual visitor, overnight guest, user of any of the facilities on the Premises, or a participant in any activity on the Premises or arranged by Guest@58 (collectively, “the Visitor”).

The Visitor acknowledges that they have read and understood this indemnity, and agree to be bound by the following:

• I enter and use the Premises, parking areas, surrounds and stairs, and participate in any activities at the Premises, entirely at my own risk.
• Right of admission is reserved.
• I confirm that I have been advised of, and am aware of, the risks and dangers at the Premises that have been explained to me, and that I understand those risks and their implications.
• Such risks include, without limitation: gas braai and open flame areas, the backup generator and power equipment, stairs and uneven surfaces, and the parking area and vehicle gate.
• Parents and guardians remain responsible for supervising children at all times, particularly around the braai areas, generator and power equipment, stairs, and the parking area and vehicle gate.
• I agree to obey, at all times, any warning notices and instructions given by Guest@58.
• I hold harmless and indemnify the owners, management, staff and directors of Guest@58, and other guests (“the Indemnified Parties”), against any consequences of visiting, or participating in any activities or incidents at, or arranged by, Guest@58, and waive any claims I may have against them.
• This includes any loss of or damage to personal effects or property, any indirect, consequential or special loss or damage, financial loss, illness, injury, harm (as defined in the CPA), or death, however caused, and legal costs (attorney and own-client scale) that the Indemnified Parties may incur — unless such a claim falls within the scope of section 61 of the Consumer Protection Act, Act 68 of 2008.
• I acknowledge that any assistance the Indemnified Parties may render or arrange is given without any admission or acknowledgement of fault or liability, and as a show of empathy and goodwill.
